DriverJobz Terms of Service

These Terms of Service (the "Agreement" or "Terms") constitute a legally binding contract between you (the "User," "you," or "your") and DriverJobz, an entity incorporated in the State of Delaware, along with its parents, subsidiaries, affiliates, representatives, and assigns ("DriverJobz," "Company," "we," "us," or "our").
PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS A MANDATORY INDIVIDUAL ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
1. ACCEPTANCE AND ELIGIBILITY
By accessing, browsing, registering for, or using the DriverJobz website, platform, application, or any associated services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all terms and conditions, you are strictly prohibited from using the Platform.
- Capacity: You represent that you are at least 18 years of age (or 21 years of age where required by federal or state law for interstate commercial driving) and possess the legal authority to form binding contracts.
- Corporate Authority: If you are using the Platform on behalf of a business entity, motor carrier, restaurant, or fleet owner, you represent that you have the authority to bind that entity to this Agreement.
2. PLATFORM CLASSIFICATION: SOFTWARE AS A SERVICE ONLY
- Not an Employer or Carrier: DriverJobz provides a digital venue (Software as a Service) connecting commercial drivers, logistics professionals, and gig-workers ("Drivers") with entities or individuals seeking to hire drivers or lease fleet vehicles ("Employers"). DriverJobz is NOT a motor carrier, freight broker, freight forwarder, employment agency, labor contractor, or vehicle leasing agency.
- No Employment Relationship: No joint venture, partnership, employment, or agency relationship exists between you and DriverJobz. Drivers are strictly independent users of the Platform. DriverJobz does not direct, control, or supervise the day-to-day activities, routes, hours, or equipment of any Driver.
- No Endorsement: DriverJobz does not guarantee the quality, safety, legality, or DOT fitness of any Driver, nor do we guarantee the validity, safety, or payment ability of any Employer. The "Verification" features on our site (such as checking an EIN or DL format) are for administrative convenience only and do not constitute a background check or endorsement.
3. ALLOCATION OF RISK AND COMPLIANCE (FMCSA & DOT)
Users assume all risks associated with interactions facilitated by the Platform.
- Employer Responsibilities: Employers are solely and exclusively responsible for complying with all applicable local, state, and federal laws, including but not limited to the Federal Motor Carrier Safety Administration (FMCSA) regulations. Employers are strictly responsible for conducting their own comprehensive background checks, obtaining Motor Vehicle Records (MVRs), checking the Drug and Alcohol Clearinghouse, and verifying medical certifications prior to hiring or leasing equipment to any Driver.
- Fleet Leasing & Individual Employers: If you use the Platform to lease vehicles, rent fleet equipment, or hire drivers for non-transportation businesses (e.g., restaurants, personal fleets), you assume all liability for vehicle maintenance, insurance coverage, and liability claims. DriverJobz entirely disclaims any liability for property damage, cargo loss, personal injury, or death arising from the use of vehicles connected through our Platform.
4. DRIVERJOBZ SMS PROGRAM & COMMUNICATIONS (A2P 10DLC)
By providing your mobile phone number and opting in via our registration forms, you expressly consent to receive automated administrative and security text messages from DriverJobz.
- 1. Program Description: DriverJobz uses SMS strictly to provide One-Time Passcodes (OTP) for account security, 2-step verification for "Pre-Hire Packets," and essential account notifications.
- 2. Opt-Out: You may revoke consent at any time. Text "STOP" to our designated shortcode or long code. You will receive one final confirmation SMS.
- 3. Assistance: For help, text "HELP" or email support@driverjobz.com.
- 4. Carrier Liability: Participating telecommunications carriers are not liable for delayed, dropped, or undelivered messages.
- 5. Rates: Message and data rates may apply depending on your mobile carrier plan. Message frequency varies based on your usage of the Platform. Consent to receive SMS is not a condition of purchasing any good or service.
5. DATA SHARING & THE "PRE-HIRE PACKET"
- Consent to Share: By submitting applications or accepting connections, you direct DriverJobz to share your profile information.
- Sensitive Data: The transmission of highly sensitive data (e.g., Full Driver's License Number, Date of Birth, Address History) contained within the "Pre-Hire Packet" is executed strictly upon the Driver's explicit approval via 2-step verification. DriverJobz acts solely as the conduit for this data and disclaims any liability for how an Employer stores or uses this data once received.
6. FEES, SUBSCRIPTIONS, AND CANCELLATION
- Promotional Period: DriverJobz may offer the Platform free of charge for an initial introductory period (e.g., the first six months post-launch).
- Future Monetization: We reserve the right, at our sole discretion, to institute fees, subscription models for Employers, or "Premier Listing" fees for Drivers.
- Notice & Consent: Users will be provided at least thirty (30) days advance notice of any mandatory fees. Continued use of the Platform after the fee implementation date constitutes agreement to pay such fees. All payments are processed by third-party processors, and DriverJobz does not store full credit card data.
7. PROHIBITED CONDUCT AND ACCOUNT TERMINATION
DriverJobz reserves the right to suspend or terminate any account, at any time, for any reason, at our sole and absolute discretion, without notice or liability. You agree not to:
- 1. Submit false, inaccurate, or misleading information (including expired licenses or fake EINs).
- 2. Use the Platform to promote illegal acts, human trafficking, or the transportation of illicit goods.
- 3. Scrape, crawl, or use automated bots to extract data from the Platform.
- 4. Harass, discriminate against, or defraud any other User.
- 5. Attempt to bypass our security measures or 2-step verification systems.
8. DISCLAIMER OF WARRANTIES
THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. DRIVERJOBZ EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRIVERJOBZ, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF WAGES, CARGO LOSS, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY INTERACTION WITH OTHER USERS, EVEN IF DRIVERJOBZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID DRIVERJOBZ IN THE PAST SIX (6) MONTHS.
10. INDEMNIFICATION
You agree to deeply indemnify, defend, and hold harmless DriverJobz, its affiliates, and their respective officers, directors, and employees from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any FMCSA, DOT, state, or federal law; (d) your misclassification of any worker; or (e) any claim arising out of an accident, injury, or property damage involving a Driver or vehicle sourced through the Platform.
11. DISPUTE RESOLUTION: MANDATORY ARBITRATION AND GOVERNING LAW
- Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any conflict of law principles.
- Arbitration: Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware or via remote video conference at DriverJobz's discretion.
Class Action Waiver: YOU AND DRIVERJOBZ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
12. SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms, alongside the Privacy Policy, constitute the entire agreement between you and DriverJobz.
